Terms and Conditions of Business

1. Agreement

These conditions govern all contracts of the sale of printed/embroidered goods (hereafter referred to as ‘the goods’) and services between All Star Collection/London1977.com (hereafter referred to as ‘the Company’ and any Customer (hereafter referred to as ‘the Customer’) of the goods and/or services. These terms can only be varied with the written consent of the Company. 

2. Orders 

All orders for the supply of goods placed by the Purchaser with the Company are irrevocable unless otherwise expressly stated in writing. A confirmed order may only be cancelled or varied with the Company’s written consent. Such consent shall not in any way prejudice the Company’s right to recover from the Customer full compensation (including profit) for any loss or expense arising from such cancellation or variation of the original order. 

3. Prices 

The Company reserves the right to vary the price of the goods and other services from time to time. All prices for goods are quoted exclusive of taxes and duty unless otherwise stated. The Customer accepts that the goods will be invoiced at the price ruling at the date of dispatch. Quotes sent are valid for 2 weeks from the date sent.

4. Payment and Credit 

Payment is due at the time of confirming the order. Credit may be extended on application to Government bodies only (i.e. Schools; NHS Trusts etc.) A credit check may be undertaken. Where a Customer has been granted credit, payment is due within 28 days of date of invoice unless otherwise agreed with the Company in writing. Interest will be charged by the Company to the Customer on all overdue sums at the rate of 4% above the Base Rate of Barclay’s Bank at that time, accruing daily (and such interest shall continue to be payable after any court judgement). The Company reserves the right to refuse to dispatch goods to a Customer whose credit account or payment is overdue. A charge of £20 will be made for each instance of a returned or non-presentable cheque.

5. Delivery and installation

The Company will use its best endeavors to deliver the goods on the required date for delivery, but does not guarantee to do so. The Company shall, under no circumstances whatsoever, be liable to the Customer for any loss, damage or expenses, whether caused directly or indirectly, by or from any delay in the delivery of the goods. Over this value, delivery is made by an independent carrier.  Delivery to the carrier will be deemed as being delivery to the Customer. Claims for shortages or non-delivery must be supported by the carrier’s consignment or delivery note on which the goods have been signed and checked at the time of delivery. Notification of shortages or non-delivery must be made by telephone within 3 working days and in writing within 5 working days. Any loss or damage by the Customer after delivery is the sole responsibility of the Customer. 

6. Specification 

6.1 Absolute consistency of sizes (which are approximate “to fit” sizes), materials, proportions, colours and shades are not guaranteed by the company and are given as guidance only. Decoration positioning may vary between garments up to 50mm. Where large prints are placed on smaller shirts we can not guarantee  complete straight print lines on these garments, this is due to the garments being removed from the platon and can usually be pulled back into shape. On occasions repeat orders may  find that the garment colour is slightly different to the previous order. We can not guarantee the exact ink colour unless a pantone colour reference is supplied and even then we can not guarantee a 100% colour match. All Star Collection cannot be held responsible for these changes

6.2 All artwork supplied by the Customer will be transferred on to a  template depicting the size and positioning of front and/or rear views. The Customer will be required to provide a thorough check including size positioning and spelling prior to any screen printing taking place. We will print your garment to match the proof..  All Star Collection cannot be held responsible for any errors including spelling mistakes which are identified in the artwork after the Customer has given their approval and screen printing has commenced.

6.3 All textile goods must be washed and cleaned strictly in accordance with the washing label instructions attached to the goods. The company reserves the right to alter or amend specifications without prior notice. 

6.4 Inks used during the textile printing process will inevitably fade over time. The speed at which they fade will be dependent on many factors including washing temperature, number of washes, exposure to sunlight etc. Therefore All Star Collection cannot be held responsible for fading ink colour(s) during use this is usually most noticeable with black ink. 

7.  Supplied Garments 

All garments supplied by All Star Collection have undergone rigorous testing for their stability throughout the process of screen-printing and embroidery as well as their overall quality. All garments supplied by All Star Collection are guaranteed to be processed successfully without damage. All Star Collection cannot be held responsible for damage or loss which occurs to garments which have been supplied by the customer. Examples of damage may include, but not be limited to, the garments changing colour or shape due to heat, or damage caused by machinery malfunction. 

8. Claims against the Company

All claims in respect of goods alleged to be defective and/or missing must be made in writing within 7 days from the date of delivery.  

9. Set-off and Lien 

No payments may be withheld and any counterclaims by the Customer may not be set-off against any payment due under this or any other contract. The Company shall have a general and particular lien on all money and property which the Customer owns or is entitled to possess which is in the possession of the Company or its agents which it may sell as the Customers agent to reduce the Customers debt to the company. 

10. Force Majeure 

The company shall not be under any liability of any kind for non-performance in whole or in part of its obligations under the contract due to causes beyond the reasonable control of the Company or of the Company’s suppliers or due to labour disputes. 

11. Ownership of Goods 

Property of any goods supplied to the Customer will not pass to the Customer until the goods are paid for in full by the Customer. Further, title to such goods shall not pass until payment to the Company of all amounts owing to it by the Customer on any account whatsoever. The Company has the right to recover from the Customer the cost of installation, removal, return transport and diminution in value of any such goods not paid for in full. If prior to making payment to the Company, the Customer contracts to sell the goods to a third party, the title to such goods and the payment liability shall remain with the Customer. 

12. Cancellations 

The company reserves the right to refuse cancellations of confirmed orders placed by the Customer, and refuse acceptance of goods returned to the Company without permission. The Company does not trade on a ‘sale or return’ basis. All costs which are the result of cancellation of a confirmed order will be borne by the Customer.

13.  Intellectual Property Rights 

The Customer will indemnify the Company from and against all costs, claims, liabilities and damages which we may suffer or incur as a result of you using, reproducing or exploiting any industrial or intellectual material or property rights without the consent of the proprietor. 

14. Rectification of these Terms 

If any of these terms, or any part of these terms, is unenforceable or void in law, it shall not affect the remainder of such terms or any other such term or otherwise affect the contract and shall be replaced by such valid term as is near as may be in effect to the original term. 

15. Jurisdiction 

All contracts between the Company and the Customers shall be governed by the laws of England and Wales. Any disputes arising there from shall be the subject to the jurisdiction of the English courts.

Welcome to the AllStarCollection website terms and conditions. Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Statement regarding personal information provided by you. Before placing an order, if you have any queries relating to these terms and conditions, please email our customer service team at sales@london1977.com. We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.

Dispatch Times

 All orders are sent by DPD couriers. Orders are sent on a next working day service unless otherwise stated, the main exception is Continental Clothing and Earth Positive. Delivery costs are  £5.99  for orders under £200 ex VAT. Orders over £200 ex VAT are free to the UK mainland.
 Cut off time for next working day delivery is 4PM. If you place your order after 4PM the order will be processed and dispatched the next working day. If you place your order after 4PM on Thursday your order will be dispatched Friday for delivery on Monday. If you place your order after 4PM on Friday your order will be processed on Monday for delivery on Tuesday. This information is only valid for next day delivery items.

Payment Options

We accept Visa, Delta/Connect, Visa Electron, Maestro, MasterCard, Solo, or PayPal. If you have paid on your credit card you will only be charged once the goods have been dispatched to the delivery address. We will email you to confirm dispatch.

If you have paid via your PayPal account, transactions are charged at the time the goods are ordered, when you click on the confirm and pay option. If for some reason we are unable to ship your goods, the value of the items that are not despatched will be refunded to the original method of payment.

Further information for overseas customers All overseas transaction must be paid for by direct bank transfer, unless agreed prior to sale.

Credit Card Validation

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this immediately at the check-out stage.

In assessing your request for goods or services, we may use your information for the purposes of the prevention and detection of fraud. One of the purposes for which we may disclose your address and postcode details is to check against the IMRG Security Alert or any other Fraud Prevention Scheme. At all times where we disclose your information it will remain secure. If you believe your details are incorrect you may correct those details by following the procedure set out in our privacy policy.

Product Information

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.

All sizes and measurements are approximate, however we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK sizes. Please refer to the size guide for clarification.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

All deliveries should be checked immediately. If there are any damages or shortages these must be reported immediately on the same day. . We make every effort to dispatch your goods on the date agreed. We can not be held responsible for goods being delayed,  or any sub-sequential losses incurred once they have left our premise

Returns

We offer a 14 days return policy. You can return your order within this time for a full refund.

We are committed to customer service. If you have purchased any items you no longer require then you can return them for a full refund. This does not include printed items or underwear. Goods must be in the same condition as they were received in.

To return your items please use the return form. To obtain a returns form please log into your account, click on order history then click on the order you wish to return items from. Then click the products within the order that you wish to return. Then scroll to the bottom of the page and click return items, you will then be emailed your returns form. Print it off and send the items back to us. Please note we do not pay for return postage and it is your responsibility to ensure the items reach us so we therefore recommend using a signed for service. If you have placed your order without opening an account please contact us and we will upgrade you so you will be able to receive a returns form.

 If you have received the wrong items or faulty items please contact us and we will raise a collection and send the correct items out to you. Please check your items before decorating or altering. We will not accept any items that have been decorated or altered under any circumstances.

Your UK statutory rights are not affected by our returns policy.

Purchase Of Products

When you place an order on our website we shall email you an acknowledgement. Once you have checked out and your order has been confirmed you will not be able to make any changes to your order so please make sure that everything is correct before clicking the confirm button. We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following: The product ordered being unavailable from stock Our inability to obtain authorization of payment The identification of an error within the product information, including price or promotion If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time.

Where applicable, you may cancel your order in accordance with your rights under the Distance Selling Regulations.

Delivery

We make every effort to dispatch your goods on the date agreed. We can not be held responsible for goods being delayed, or any sub-sequential losses incurred once they have left our premises.
